Context
Construction data in valuation
The market value is determined under § 194 BauGB by the price that could be achieved in the ordinary course of business on the valuation date. Decisive are the general value conditions on the valuation date: the totality of circumstances relevant to price formation, such as the general economic situation, capital market conditions and the economic and demographic developments of the area (§ 2 para. 2 ImmoWertV). They enter the valuation procedure through the input data and the market adjustment (§ 7 ImmoWertV).
- Construction price index: In the cost approach, the standard construction costs (NHK) 2010 are to be converted using the construction price index of the Federal Statistical Office that is current at the valuation date and appropriate for the type of structure (§ 36 para. 2 ImmoWertV). - Purchase values for building land: The statistical averages are not standard land values. Land value is primarily determined by the comparative method; an object-specifically adjusted standard land value may be used alongside or instead of comparable prices (§ 40 para. 1 and 2 ImmoWertV). Standard land values are determined by the expert committee (Gutachterausschuss) (§ 196 BauGB).
- Construction activity: Permits and completions show supply development at the location. Together with population development they are part of the economic and demographic developments of the area (§ 2 para. 2 ImmoWertV).

Which construction price index applies for converting the NHK 2010?
The construction price index of the Federal Statistical Office that is current at the valuation date and matches the type of structure (§ 36 para. 2 ImmoWertV); for residential buildings, the index for new conventionally built residential buildings including VAT.
Why do purchase values for building land differ from standard land values?
The statistics reflect the average of all building plots sold in the year, regardless of location, size and usability. Standard land values, by contrast, are average location values for zones with largely identical plot features (§ 196 para. 1 BauGB).
What is the difference between a building permit and a building completion?
Permits show planned construction, completions show construction actually ready for occupancy. Between the two there are usually one to three years; not every permitted project is built (backlog of approved dwellings).
